The High Court is set to deliver its ruling on Thursday on whether there is a “no case to answer” in the high-profile Katanga murder trial, a decision that will determine whether the accused persons will be required to defend themselves or be acquitted at this stage.
The ruling follows submissions by the defense team after the prosecution closed its case. The defense argued that the state failed to present sufficient evidence to establish a prima facie case against the accused and therefore asked the court to dismiss the charges without requiring them to enter a defense.
Under criminal procedure, a “no case to answer” submission is made when the defense contends that the prosecution’s evidence is too weak, inconsistent, or insufficient to sustain a conviction, even if left unchallenged. At this stage, the trial judge must determine whether there is credible evidence linking the accused to the alleged offense.

If the court agrees with the defense, the accused will be acquitted immediately, bringing the trial to an end. However, if the judge finds that the prosecution has established a prima facie case, the accused will be placed on their defense. They will then have the option to give sworn or unsworn statements and to call witnesses in support of their case.
The Katanga murder trial has drawn widespread public interest due to the profile of the individuals involved and the circumstances surrounding the death at the center of the case. Over the course of the trial, the prosecution presented witnesses and exhibits aimed at linking the accused to the crime, while the defense consistently challenged the reliability and sufficiency of that evidence.
Legal observers describe Thursday’s ruling as a critical turning point. The decision will determine whether the matter proceeds to the defense stage or concludes at this juncture.
The court is expected to deliver the ruling on Thursday morning.
